Abstract

Perkembangan cryptocurrency sebagai bagian dari ekonomi digital telah menghadirkan peluang sekaligus tantangan baru bagi perlindungan Hak Asasi Manusia (HAM). Cryptocurrency tidak hanya berfungsi sebagai inovasi teknologi atau instrumen ekonomi, tetapi juga sebagai fenomena sosial-ekonomi yang berdampak langsung pada hak atas privasi, kepemilikan, penghidupan yang layak, akses ekonomi, serta lingkungan hidup. Penelitian ini bertujuan untuk menganalisis penggunaan cryptocurrency dalam perspektif hak asasi manusia serta mengkaji peran negara dalam menyeimbangkan kebebasan individu dan kepentingan publik di era ekonomi digital. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Penelitian ini menemukan bahwa penggunaan cryptocurrency menimbulkan benturan multidimensional antara inovasi ekonomi digital dan kewajiban negara dalam melindungi HAM. Benturan tersebut tidak bersifat absolut, melainkan mencerminkan kebutuhan akan pengaturan yang berlandaskan prinsip legalitas, proporsionalitas, dan akuntabilitas. Penelitian ini menyimpulkan bahwa pendekatan berbasis HAM menjadi kerangka normatif yang penting agar pengelolaan cryptocurrency tidak bersifat represif, namun tetap mampu melindungi masyarakat serta memastikan bahwa transformasi ekonomi digital berlangsung secara adil, inklusif, dan berkelanjutan.
